1. PROMOTION PERIOD: Starts June 1st, 2012 at 9:00:00 AM Central Time (“CT”) and ends July 31, 2012 at 11:59:59 PM CT (the “Promotion Period”). The Sponsor’s computer shall be the official time keeper for this method of play.

ELIGIBILITY: You must be a legal resident of the 50 United States or the District of Columbia who is 18 years of age or older, AND have a valid email address. Void where prohibited. Directors, officers, or employees of Kimberly-Clark Global Sales, LLC, Walmart and their parent, subsidiaries, franchisees, agents, suppliers, or service agencies, and individuals engaged in the development, production or distribution of materials for the Promotion or engaged in the administration or execution of this Promotion (collectively, the “Promotion Entities”), and persons who are the immediate family (spouse, parent, child, sibling and their respective spouses) of, or reside in the same household (i.e., live in the same household for at least 3 of the 12 months preceding the start of the Promotion Period, whether related or not) are not eligible.

1. HOW TO ENTER: Send a text message with the keyword “UbyKotex” to the shortcode “222377”. You will receive a text message indicating whether you are a Potential Winner or not. (See Rule #6 below for details on how to claim your prize in case you are a Potential Winner.) (Standard text messaging rates will apply.Participants must have a mobile phone with text messaging capabilities to enter by text message. Please check with your wireless carrier for availability and pricing details.) Participants are solely responsible for any wireless charges relating to their entry into the Promotion. Proof of text message does not constitute proof of delivery or play. To enter without sending a text message, use the free entry method described in Rule #5 below.Limit: One (1) Instant Win Game play per person, regardless of method of entry, permitted per day. If it is discovered that you attempted to play more than once per day, such as using multiple mobile numbers and/or email addresses, all of your game plays will be declared null and void, and any prize you might have been entitled to receive will be forfeited and will not be awarded to you. All entries must be submitted by July 31, 2012 at 11:59:59 PM CT to be eligible. All entries become property of the Sponsor and will not be returned.

   All prize awards are subject to verification of eligibility and compliance with the terms of these Official Rules. Instant Win prizes are randomly time seeded throughout the Promotion Period and awarded to the person who plays at or closest after the time the prize is randomly seeded (regardless of method of entry). The number of entries received and the time of day when you play the Instant Win Game during the Promotion Period (as recorded by the Sponsor’s computers) will solely determine whether or not you are a potential winner.

   Odds of winning an Instant Win Game prize depend on the number of Instant Win prizes available divided by the number of eligible Instant Win Game plays. Limit: One (1) Instant Win Game prize per person.

   Total ARV of prizes available to be won is USD $30,748.00.

   Sponsor reserves the right to conduct a random drawing at the end of the Promotion Period from among all eligible entries received to award any prizes that went unawarded for any reason, including Prizes that were not played for by the end of the Promotion Period.

   Winners acknowledge that Promotion Entities have not made nor are in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to the prizes, including but not limited to their quality, mechanical condition or fitness for a particular purpose. Any and all warranties and/or guarantees on a prize (if any) are subject to the respective manufacturers’ terms therefore, and Winners agree to look solely to such manufacturers for any such warranty and/or guarantee.

   Prizes are not transferable, or redeemable for cash (if applicable), and must be accepted as awarded, with no substitutions of any kind, except by the Sponsor, who reserves the right to substitute a prize (or portion thereof) with one of comparable or greater value, at its sole discretion.

   All federal, state, and local taxes (including income and withholding taxes), if any, as well as any other costs and expenses associated with prize acceptance and use not specified herein as being provided, are each Winner’s responsibility. All prize details are at the Sponsor’s sole discretion.

TO ENTER WITHOUT TEXTING: To enter without texting, visit http://ubykotex.securepromotion.com/npnduring the Promotion Period, log in to your account (or register your information as required � registration is free), and read and accept these Official Rules, then follow the instructions to find out if you are a winner (a “Play Receipt” with your game result including a unique Security Identification Code (SIC) will be shown onscreen). If you are a winner, the Play Receipt and SIC will also be automatically sent to your email address as provided by you in the registration process.Entries submitted by script, macro or other automated or mechanical means, entries by any means which subvert the entry process and entries made in any fashion other than as specified herein are void. All entries become property of the Sponsor and will not be returned.

1. HOW TO CLAIM YOUR PRIZE: Potential Winners playing via text message will receive a Claim Code by text message (equivalent to the “Play Receipt”). To claim a prize, Potential Winners should enter his/her mobile phone number and Claim Code at http://ubykotex.securepromotion.comand follow the instructions to read and accept these Official Rules and complete the registration form by 11:59:59 PM CT on August 14, 2012. Prizes won by Potential Winners who played using the online method will be delivered by mail. All prizes won and claimed will be mailed to the verified Winner’s address as provided in the registration form. If applicable, any prize won by an entrant who is eligible but still considered a minor in his/her state of residence will be awarded to a parent or legal guardian of such minor, who must comply with all requirements imposed on Winner(s) set forth herein. If a Potential Winner is found to be ineligible or not in compliance with these Official Rules, declines to accept the prize, if Sponsor is unable to contact Potential Winner within a reasonable period, or in the event that a prize notification or prize is returned undeliverable, the prize will be forfeited. Each Potential Winner (or parent/legal guardian where applicable) may be required to furnish proof of identification to determine eligibility.Allow 6-8 weeks for verification and shipment of your prize. Promotion Entities shall not be held responsible for any delays in awarding prizes for any reason outside of their control. Prizes will only be delivered to verified Winners.

   By accepting a prize, each Winner consents to the use of his/her name, address (city and state of residence), voice, and statements relating to the Promotion or Sponsor, and photographs or other likenesses, without further compensation, notification or permission in any publicity or advertising carried out by Sponsor or any related entities in any and all media now known or hereinafter developed without territorial or time limitation, except where prohibited by law.

CONDITIONS OF ENTRY:

1. By entering, entrants (i) acknowledge compliance with these Official Rules including all eligibility requirements and, (ii) agree to be bound by the decisions of the Sponsor and/or Promotion Judges, made in their sole discretion, which shall be final and binding in all matters relating to this Promotion. Entrants who have not complied with these Official Rules are subject to disqualification and all associated entries will be void.

1. Sponsor reserves the right to disqualify any entrant’s registration in the Promotion (and void all associated entries) or entitlement to a prize, if, in the sole discretion of the Sponsor, it determines or suspects that the entrant has attempted to undermine the legitimate operation of the Promotion by cheating, hacking, deception, or other fraudulent, deceptive or unfair playing practices (including any entries generated by script, macro, robotic, programmed, or any other automated means or any other means which subvert the entry process).

1. If a dispute arises regarding who submitted an entry/game play, the entry/game play will be deemed to be submitted by the authorized account holder of the email address or cellular phone provided at time of registration or entry. Authorized account holder of an email address is defined as the natural person who is assigned to an email address by an Internet access provider, online service provider, or other organization responsible for assigning email addresses for the domain associated with the submitted email address. Authorized account holder of a cellular phone number is defined as the natural person who is assigned to a cellular phone number by the wireless carrier responsible for assigning the cellular phone number associated with the submitted entry/game play.

1. As a condition of entering, entrants (or as applicable, their parents or legal guardians if eligible minors) agree: (a) to release Sponsor and Promotion Entities, and each of their officers, directors, employees and agents, from any and all liability, loss or damage incurred with respect to participating in the Promotion or the awarding, receipt, possession, and/or use or misuse of any prize or any travel or activity related thereto, (b) that under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim punitive, incidental, consequential, or any other damages, other than for actual out-of-pocket expenses; (c) all causes of action arising out of or connected with this Promotion, or any prize awarded, shall be resolved individually, without resort to any form of class action; and (d) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, and in no event will entrants be entitled to receive attorneys’ fees and court costs.

1. Sponsor reserves the right in its sole discretion to cancel, modify or suspend this Promotion at any time if fraud, technical failures, including any network server or hardware failure, viruses, bugs, errors in programming, or any other errors or other causes corrupt the administration, security, integrity or proper play of the Promotion. In the event of cancellation, Sponsor reserves the right to select the Winner(s) from among all eligible, non-suspect entries received up to time of such cancellation.

1. Promotion Entities do not warrant that access to the Promotion will be uninterrupted. Promotion Entities are not responsible for any problems that may arise, including but not limited to: (a) lost, interrupted, inaccessible or unavailable networks, servers, satellites, Internet Service Providers, websites, or other connection, availability or accessibility problems arising in connection with or over the course of the Promotion; or (b) communications failed, jumbled, scrambled, delayed, or misdirected computer, telephone or cable transmissions or hardware or software malfunctions, failures or difficulties; or (c) failure of personal computers and/or software and hardware configurations, any technical malfunctions, failures, or difficulties, printing errors, clerical, typographical or other error in connection with the administration of the Promotion, the offering or announcement of any prize or in any prize notification documents; or (d) for any other errors of any kind relating to or in connection with the Promotion, whether human, mechanical, clerical, electronic, or technical in nature; or (e) the incorrect or inaccurate capture of information, or the failure to capture any information in connection with the Promotion; or (f) damage to a user’s system occasioned by participation in this Promotion or downloading any information necessary to participate in this Promotion. Promotion Entities are also not responsible for lost, late, delayed, garbled, stolen, incomplete, misdirected, illegible, damaged, or undelivered entries. Proof of transmission (screenshots or captures of game play, etc.) does not constitute proof of delivery.
