1. ELIGIBILITY. The Game is open only to legal residents of the fifty (50) United States and the District of Columbia (D.C.) who are eighteen (18) years of age or older at the time of entry. If the entrant is an eligible minor (e.g. 19 years of age in NE or AL), a parent or legal guardian must, on behalf of the minor, agree to be bound by these Official Rules. If an eligible minor entrant is a prize winner, his/her parent or legal guardian must accept the prize awarded and execute and return all required releases on his/her behalf. The Game is not open to persons who are in the employment of Sponsor, or any of their respective parent companies, affiliates or subsidiaries, distributors, Game material suppliers, promotion or media partners, printer(s) of Game materials or advertising, promotion or other coordinating agencies involved in this Game or the immediate family members (biological or step-parent, grandparent, child, sibling or spouse of any of the foregoing), regardless of where they live, or household members of any of the above, whether related or not.
2. HOW TO OBTAIN GAME CODES. Official Game Codes (“Game Codes”) can be obtained as follows (the following methods are collectively referred to as “Legitimate Channels”):
A. ON PACKAGING. Beginning on or about April 30, 2012, purchase any specially-marked Hostess Multi-Packs: Twinkies®, Chocolate CupCakes, SnoBalls®. One Game Code will be located on each package.
B. WITHOUT PURCHASE. To obtain a free online Game Code, visit www.hostesscakes.com (“Game Site”) and click on the link to the Game. On the Game Site, click on the “Need a Code” link on the code entry page to receive your Game Code. Limit one (1) Game Code per person/email address per day. For purposes of the Game, a “day” shall be defined as 12:00:00 a.m. CT to 11:59:59 p.m. CT.
3. HOW TO PLAY. Visit www.hostesscakes.com and click on the link to the Game. On the Game Site, participants will be required to enter their date of birth prior to registering. Once a participant is verified as eligible to play, s/he will be required to register by completing the form as indicated. Registration is free. Returning entrants can enter Game Codes using the email address and password established during registration. Limit one (1) registration per person. After completing all required fields on the registration form or entering using email address and password, entrants will follow on-screen prompts to enter the 8-digit Game Code and begin Game play (“Game Play”). If the word “WINNER!” and a prize description appear, you are the winner of a prize, subject to verification. If the word “Sorry” and a non-winning message appear, you did not win a prize.
4. ENTRY LIMITATIONS. Limit one (1) Game Play per person/email address per day, regardless of the method through which you obtained the Game Code and played the Game. Multiple entrants are not permitted to share the same email address. Any attempt by an entrant to obtain more than the stated number of Game Play by using multiple/different email addresses, identities, registration or any other methods will void that entrant’s Game Plays and that entrant may be disqualified. Automated Game Plays are prohibited, and use of any automated devices will cause disqualification.
5. PRIZES. One (1) Grand Prize: VIP Trip to New York City for Four. The Grand Prize trip includes round trip coach airfare for winner and three (3) guests from a major commercial airport nearest to the winner’s residence within the 50 United States to New York, NY; four (4) days’/three (3) nights’ (quad occupancy) hotel accommodations; limo service to/from hotel/airport; $2,000 spending money for winner only and one (1) $500 VISA gift card for winner only. If winner lives within 200 miles of New York, NY, ground transportation will be awarded in lieu of airfare, in Sponsor’s sole discretion. The winner must provide transportation from his/her residence to the major commercial airport. Approximate Retail Value (“ARV”) of Grand Prize: $7,100. The ARV of the Grand Prize is based on estimated airfare, hotel and expenses as of November, 2011. Actual value may vary based on point of departure and/or airfare fluctuations and any difference between that stated ARV and the actual value of the prize will not be awarded. Alternatively, the Winner may opt in writing to accept a check for $7,100 payable to the Winner in lieu of the Grand Prize.
Sixty-two (62) First Prizes: $50 MLB.com Gift Card. Gift card subject to terms and conditions listed thereon. ARV of First Prize: $50 each.
Total ARV of all prizes is $10,200.
6. WINNER SELECTION/ODDS. All Prizes will be randomly time seeded throughout the Promotion Period, and awarded to the first eligible person who plays on or after the time the prize is randomly seeded. Odds of winning depend on the number of eligible plays received and the order in which such plays are received. There are a total of one (1) Grand Prize and sixty-two (62) First Prizes available to be won. Limit one (1) prize per person/household. All potential winners are subject to verification by Sponsor or Wunderman, an independent judging organization, before any prize is awarded. Decisions of the judging organization are final, binding and conclusive in all matters. An entrant is not a winner of any prize, even if the Game should so indicate, unless and until entrant’s eligibility has been verified and entrant has been notified that verification is complete. Sponsor will not accept screen shots or other evidence of winning in lieu of its validation process. Any Game Play that occurs after the system has failed for any reason is deemed a defective Game Play and will not be honored.
7. HOW TO CLAIM PRIZES. Potential winners who played the Game will be required to follow online prompts to claim their prize. The potential winner of the Grand Prize will be sent an email containing prize claim instructions to the email address provided during registration within forty-eight (48) hours of the winning Game Play. The potential Grand Prize winner will be required to sign and return the Affidavit of Eligibility and Liability/Publicity Release (except where prohibited) within five (5) days of the date of attempted notification, or prize may be forfeited. Prizes won by an eligible entrant who is a minor in his/her state of residence will be awarded to minor’s parent or legal guardian, who must sign and return all required documents and accompany winner on prize travel, if applicable. Minors must be accompanied at all times during the trip (including, but not limited to in-flight and hotel stay) by minor’s parent or legal guardian. Upon receipt and verification of Grand Prize winner affidavit, the winner will be notified via phone regarding the specific travel details of the prize. Telephone calls, meals, gratuities, luggage fees, incidental hotel/personal expenses and all other expenses not specified herein are the responsibility solely of winner. Sponsor reserves the right to structure travel destination, routes and hotel selection at its sole discretion. Winner and guests must travel on the same itinerary. Winner’s guests must also sign and return a Liability Release and Publicity Release prior to ticketing of travel. Winner and guests must have all necessary identification and/or travel documents (e.g., a valid U.S. driver’s license) required to travel. Trip prize (or any portion thereof) may not be sold, traded, transferred, assigned, refunded or redeemed for cash, except for as allowed herein. Except where prohibited by law, winners grant (and agrees to confirm this grant in writing, if requested) permission for Sponsor and those acting under its authority to use their name, photograph, voice and/or likeness, for advertising and/or publicity purposes in any and all media now known or hereinafter invented without territorial or time limitations and without compensation. Winners (or parent or legal guardian if winner is a minor in his/her state of residence) shall be solely responsible for all applicable federal, state and/or local taxes, and the reporting consequences thereof, and for any other fees or costs associated with the applicable prize, if any. Winners (or parent or legal guardian if winner is a minor in his/her state of residence) are advised to seek independent counsel regarding tax implications of their prize winnings. First Prizes will be shipped within 4-6 weeks after winner verification. Sponsor reserves the right to substitute a prize of equal or greater value if advertised prize is unavailable. Prizes are not transferable, assignable or redeemable for cash. In the event there is a dispute as to the identity of a winner, the winning Game Play will be deemed made by the person listed in the registration information. Unclaimed prizes will not be awarded. Grand Prize winner will be issued an IRS 1099 form for the value of the prize.
