The Allergy Makeover Instant Win Game (the “Promotion”) is sponsored by Allegra®, Chattem, Inc., 1715 West 38th Street, Chattanooga, TN 37409 (“Sponsor”), and is administered by Prize Logic, LLC, an independent judging organization, 25200 Telegraph Road, Suite 405, Southfield, MI 48033 (“Administrator” or “PrizeLogic”).
1. PROMOTION PERIOD: The Promotion Period starts on May 1, 2012 at 12:00 a.m. (midnight) Eastern Time (“ET”) and ends on May 31, 2012 at 11:59:59 p.m. ET (“Promotion Period”). The Administrator’s clock is the official clock for this Promotion.
2. ELIGIBILITY: This Promotion is offered only to legal United States residents in the 50 United States and the District of Columbia, who are at least eighteen (18) years of age or older as of the date of entry. Employees of Sponsor, Administrator, MARS Advertising, Inc., Mercury Promotions & Fulfillment, and any of their respective owners, parent companies, affiliates, directors, subsidiaries, franchisees, representatives, advertising, promotion and production agencies, agents (collectively “Promotion Entities”) and their immediate family members (i.e., spouse, parent, child, sibling, and the “steps” of each) and persons living in the same household of each are not eligible to participate in the Promotion. All federal, state and local laws and regulations apply. Void in Puerto Rico, the United States Possessions and Territories, and where prohibited or restricted by law.
3. HOW TO ENTER: During the Promotion Period, an eligible entrant (“Entrant”) must logon to www.theallergymakeover.com (the “Website”).
The Entrant must first register by entering the information requested on the registration page, including his/her complete first and last name (no initials), e-mail address, complete residential address (P.O. Boxes are not accepted), state, zip code, telephone number, gender, and date of birth.
After the Entrant registers for the Promotion, the Entrant must play the Instant Win Game and, upon completion of the Instant Win Game, the Entrant will receive a win/lose Instant Win Game Play message. Each Entrant who receives a winning message will be deemed to be a potential Winner pending confirmation and/or verification of the Entrant’s eligibility and compliance with the Official Rules as determined by Sponsor in its sole discretion.
Each day during the Promotion Period after registration, an Entrant may logon to the Website, enter his/her e-mail address and play the Instant Win Game. An Entrant is limited to a maximum of one (1) entry per calendar day into the Instant Win Game. The use of an agency or any automated system to enter in excess of the stated limit is strictly prohibited and Sponsor reserves the right to disqualify any entries received through such methods, as determined by Sponsor, in its sole discretion.
A Prize may not be awarded on each day of the Promotion Period. A “calendar day” is defined as starting at 12:00:00 A.M. ET and ending at 11:59:59 P.M. ET of that day. No more than one (1) Prize will be awarded per household throughout the Promotion Period, regardless of number of e-mail addresses used.
4. PRIZES, ODDS OF WINNING AND APPROXIMATE RETAIL VALUE (ARV):
A. Prizes (100). Each Winner will receive a Fifty Dollar ($50.00) CVS® Gift Card. Each CVS Gift Card is subject to the terms and conditions set forth on the gift card/coupon. Each CVS Gift Card is redeemable for merchandise only and will not be redeemed or exchanged for cash, except where required by law. CVS Gift Cards will not be replaced or replenished if they are lost, stolen, damaged, destroyed or used without your permission and will be voided if altered or defaced.
B. Odds of Winning a Prize. In order for an Entrant’s Instant Win Game play to result in the Entrant being a potential Winner, it must have occurred either at the exact randomly predetermined winning time as determined by Sponsor and/or Administrator or, if no Instant Win Game play has occurred at the exact randomly predetermined winning time, then it must be the Instant Win Game play that occurred at the closest time immediately following the randomly predetermined winning time. If an Entrant receives a winning message, the Entrant will be deemed a potential Instant Win Game Winner pending confirmation and/or verification of the Entrant’s eligibility and compliance with the Official Rules as determined by Sponsor in its sole discretion. The number of Prizes available to be won will decrease during the Promotion Period as Prizes are played for and/or claimed. The total number of Prizes will not exceed one hundred (100). All Prizes will be awarded provided there are a sufficient number of eligible Winners. Prizes that are unclaimed, unredeemed or returned as undeliverable will not be awarded.
C. ARV. The ARV of all Prizes is Five Thousand Dollars ($5,000).
5. HOW TO CLAIM PRIZES:
A. The potential Winners will receive notification on the Website screen after the completion of the Instant Win Game play, and Sponsor will also attempt to notify such potential Winners via e-mail at the e-mail address provided by the potential Winner at the time of registration. Upon verification of eligibility, a Prize will be mailed to the Winner by first class mail. If a potential Winner is found to be ineligible; is not in compliance with these Official Rules; declines to accept the Prize; or if the Prize is returned as undeliverable, the Prize will be forfeited and, in the Sponsor’s sole discretion, may or may not be awarded to an alternate Winner selected at random from the remaining pool of eligible Entrants. The Prize will be mailed to the address set forth on the Winner’s registration page. Allow 6-8 weeks for delivery from the end of the Promotion Period.
B. The right to receive a Prize is non-assignable, non-transferable and no prize substitution, exchange or cash equivalent will be allowed, except by Sponsor who reserves the right to substitute prize of equal or greater value in case of unavailability of prize or force majeure. Federal, state and local taxes, if any, are solely the responsibility of each winner.
