The 2012 Oreo® Blizzard® 100 Promotion consists of a grand prize drawing and various weekly, semi-monthly and monthly random drawings (“Promotion”) and will commence at 8:00:00 AM Eastern Time (“ET”) on April 1, 2012 (the “Start Date”) and end at 11:59:59 PM ET on August 31, 2012 (the “End Date”) (the “Promotion Period”). All dollar amounts referred to in these Official Rules are in U.S. currency.
1. ADMINISTRATOR/SPONSOR.
The Promotion is sponsored by American Dairy Queen Corporation (“Sponsor”) and will be administered by Brandmovers, Inc. (“Administrator”).
2. ELIGIBILITY.
The Promotion is open to legal residents of Canada (excluding Quebec), the United States, and the District of Columbia (excluding Guam, Puerto Rico, and all other U.S. and foreign territories and possessions) (“Eligibility Area”) who are 13 years of age or older as of the commencement of the Promotion Period. Notwithstanding the foregoing, no person under the age of 18 (as of the commencement of the Promotion Period) may be a Promotion Team Captain (as defined below). Directors, officers, employees, agents and representatives of Sponsor, Sponsor‘s franchisees, and Administrator, and each of their respective parent, sister, affiliates, subsidiaries, advertising and promotional agencies, and all other corporations, partnerships, sole proprietorships or other legal entities or individuals associated with the development, administration, or fulfillment of this Promotion (collectively, the “Promotion Entities”), and the immediate families of such persons (defined as spouse, child, sibling, parent or grandparent or so-called “step” or “half” variations of any of the preceding individuals, regardless of where they live), and those living in their same households, whether or not related, are ineligible to enter, win or collect prizes in the Promotion. The Promotion is subject to all applicable federal, state, provincial, territorial, municipal, and local laws, regulations, and ordinances, and is void in Quebec, outside Canada, the fifty (50) United States, and the District of Columbia, and where prohibited by law.
3. HOW TO PARTICIPATE.
NO PURCHASE NECESSARY. There are two (2) possible ways to participate in the Promotion: (A) the mobile method via one of the Promotion Sites and use of a Location Based Network, as described below; or (B) via mail.
Note for mobile users: Entrants who access content online will be charged according to their carrier‘s standard data rates and entrants should contact their carrier for pricing plans and details. Check your owners‘ manual for specific web access instructions. Standard message and data rates apply.
(A) The mobile method via a Promotion Site and use of a Location Based Network: To participate via mobile device, a participant must be a registered member of www.facebook.com. If participant is not a registered member of www.facebook.com, participant must visit www.facebook.com to register for free. Registration for and use of the www.facebook.com system and other Facebook applications are subject to Facebook‘s terms and conditions, and Sponsor has no responsibility with respect to such registration or use. During the Promotion Period, find the “Oreo Blizzard 100” tab on the DQ® Facebook page located at www.facebook.com/dairyqueen (“Facebook Site”), or visit the www.dq.com/oreo website (“DQ Site,” and together with the Facebook Site, the “Promotion Sites”), follow all of the on-screen instructions to register for the Promotion and form a Promotion team (“Promotion Team”), which Promotion Team must consist of one (1) Promotion Team captain (“Promotion Team Captain”) and a minimum of two (2), and a maximum of nine (9), additional Promotion Team members (collectively with the Promotion Team Captain, the “Promotion Team Members”). The Promotion Team Captain must complete the registration process for his/her Promotion Team. All Promotion Team Members must (i) be Facebook friends with the Promotion Team Captain, (ii) receive a “team request invitation” to join the Promotion Team from such Promotion Team Captain, and (iii) complete and submit a Promotion registration form located at the Facebook Site or the DQ Site. Each Promotion Team Member will be required to provide all of the requested information including, participant‘s first and last name, e-mail address, mailing address, telephone number, age and any other information requested by Sponsor. Participants may also be asked to consent to receive promotional e-mails from Sponsor, its promotion partners, affiliates and/or authorized agents. Consenting to receive promotional e-mails is optional and refusal to consent will not render any participant or Promotion Team ineligible to participate in the Promotion or win any prize or affect or reduce any participant‘s or Promotion Team‘s chances of winning. Limit one (1) Promotion Team per person and/or email address and per Facebook account during the Promotion Period. Only one (1) Facebook account may be used in connection with this Promotion. Any person who attempts to participate with, or join, multiple Promotion Teams by using multiple e-mail and/or street addresses, under multiple identities or uses any device or artifice to participate in violation of applicable entry limitations may be disqualified by Sponsor in its sole discretion. Any use of robotic, repetitive, automatic, programmed or similar participation methods or agents will void such participation in the Promotion. In the event of a dispute over who is part of any Promotion Team, the authorized subscriber of the e-mail account provided in connection with the applicable Promotion Team registration, as of the actual time that such information was received by Sponsor, will be deemed to be the Promotion Team Member. The “authorized account subscriber” is defined as the natural person who is assigned an e-mail address by an Internet access provider, online service provider or other organization (e.g. business, education, institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. The applicable Promotion Team Member may be required to show proof of being the authorized account holder. Each Promotion Team Member is required to indicate his/her acceptance to the Official Rules where indicated at the time of registration; provided, however, that any Promotion Team Member‘s participation in the Promotion constitutes and is deemed such Promotion Team Member‘s full and unconditional agreement to the Official Rules and any and all decisions of Sponsor and any third-party judges, which are final and binding in all respects. All Promotion Team Members agree to waive any right to claim ambiguity in the Promotion and/or these Official Rules. This Promotion is not sponsored, endorsed or administered by Facebook. All information submitted by participants in connection with this Promotion is being submitted to Sponsor, not Facebook. Any questions, comments or complaints regarding the Promotion must be directed to Sponsor and not Facebook. To the extent of any conflict between these Official Rules and Facebook terms, guidelines or policies, these Official Rules will apply.
After registering and during the Promotion Period, Promotion Team Members must visit participating DQ® locations in the Eligibility Area (each, a “DQ Location”) and “check-in” on their mobile device using the “Facebook Places” application from their mobile desktop or linked from the DQ mobile Site (the “Location Based Network”). Each time a Promotion Team Member submits a valid “check-in” at a DQ Location in accordance with these Official Rules, such person’s Promotion Team will receive one (1) check-in credit (a “Check-in Credit”). Once a Promotion Team accumulates one hundred (100) Check-in Credits, that Promotion Team will be eligible for and automatically entered into the Grand Prize Drawing (“Grand Prize Drawing”). No more than (1) Check-in Credit will be awarded to any individual Promotion Team Member in connection with such person’s “check-in” at any single DQ Location during the same calendar day. During the Promotion Period, a Promotion Team will receive a maximum of 10 Check-in Credits in connection with the “check-in” from any single DQ Location. In order to “check-in” to a DQ Location, participant must be in or immediately adjacent to the DQ Location’s perimeter and use his/her wireless mobile device to access the Location Based Network and follow the system’s instructions to “check-in” to the location that corresponds to the DQ Location. PAYMENTS AND PRODUCT PURCHASES AT DQ LOCATIONS ARE NOT REQUIRED TO PARTICIPATE IN THE PROMOTION. The DQ Site’s clock will be the official clock to determine the date and time the “check-in” was received. In the event of a dispute as to the identity of a mobile participant, the authorized account holder of the Facebook account will be deemed to be the participant. A prize winner (as hereinafter defined) may be required to show proof of being the Facebook account holder. The “Facebook account holder” is the natural person assigned to the www.facebook.com account by Facebook. Submitting mass check-ins or entries generated by a script, macro or use of automated devices is prohibited and will result in disqualification. Subject to these Official Rules, in the event that any person submits a valid “check-in” at a DQ Location pursuant to these Official Rules during the Promotion Period, but prior to joining a Promotion Team, all such DQ Location “check-ins” will be eligible for Check-in Credits following such person’s registration and receipt and acceptance of a team request invitation. Participants who do not desire to participate via mobile device through the Facebook free smart phone application and by checking into participating DQ Locations using www.facebook.com may enter using the mail-in method as described below in (B).
(B) Mail: To participate in the Promotion via the mail-in alternative means of participation, legibly print your first and last name, mailing address, email address, phone number and date of birth on a 3×5 card and mail such card to: 2012 Oreo Blizzard 100, c/o Brandmovers, PO Box 93367, Atlanta, GA, 30377. Each card must mailed in a separately stamped envelope. All mail-in cards must be hand-written by the entrant him/herself, postmarked by August 31, 2012, and received by September 7, 2012. For each eligible mail-in card Administrator receives, sender will receive three (3) Check-in Credits. The Check-in Credits will be counted as if they were submitted on the day that the envelope is post-marked. Limit one (1) mail-in card per person per calendar day during the Promotion Period. No mechanically reproduced or computer-generated requests allowed. All mail-in envelopes become the exclusive property of Sponsor and none will be acknowledged or returned. Proof of sending or submission will not be deemed to be proof of receipt by Administrator.
4. PRIZES and WINNER SELECTION.
Subject to these Official Rules, on or about September 20, 2012 exactly one (1) Promotion Team or mail-in participant, as applicable (the potential “Grand Prize Winner”), will be selected from among all of the Promotion Teams and mail-in participants eligible for the Grand Prize Drawing during the Promotion Period and such potential Grand Prize Winner will be eligible to receive $100,000.00 in local currency (the “Grand Prize”) (awarded by way of a check) In addition to the Grand Prize, various other prizes (“Check-in Prizes”) will be awarded throughout the Promotion Period by random drawings from among Promotion Teams, Promotion Team Members and/or mail-in participants, as applicable, that meet the Check-in Credit/mail-in requirements described in these Official Rules. There are three hundred and sixty-six (366) Check-in Prizes available to be won at the start of the Promotion. The number of Check-in Prizes available to be won will diminish as they are awarded throughout the Promotion Period. Not all prizes will be awarded. The Grand Prize and Check-in Prizes (collectively, “Prizes”) are described in the “Prize Schedule” below and will be awarded as set forth in such Prize Schedule.

All Prizes will be awarded in local currency. All gift certificates and/or gift cards awarded pursuant to this Promotion shall be subject to the terms and conditions of the applicable certificates and cards, and the laws and regulations of the winner’s jurisdiction of residence. The approximate retail value of all Prizes awarded in connection with the Promotion is $110,700.00 in local currency. All Prizes awarded to a Promotion Team shall be awarded to and in the name of the applicable Promotion Team Captain, on behalf of, and for the benefit of all of the Promotion Team Members. Neither Sponsor nor Administrator are responsible for any disputes between Promotion Team Members relating to: (i) entry or participation in this Promotion; (ii) the receipt, possession, use or misuse of any prize in this Promotion; (iii) the distribution of prizes amongst Promotion Team Members; or (iv) for the actions or omissions of any Promotion Team Captain. Sponsor will not replace any lost or stolen Prizes. Prizes include delivery to one (1) address only, as supplied by the Promotion Team Captain. Allow 4-6 weeks for delivery of Prize. Unclaimed prizes will not be awarded. Grand Prize Winner is solely responsible for any and all applicable fees and taxes associated with receipt and use of the Grand Prize and Sponsor will provide the Grand Prize Winner with an IRS Form 1099 (for U.S. winners) reflecting the actual final retail value of the Grand Prize, or such other governmental tax forms that may be necessary, as determined in the sole discretion of Sponsor. The Promotion is in no way sponsored, endorsed, administered by, or associated with Facebook. Participants understand that all information provided by participant is being provided to Sponsor and not Facebook.
5. HOW TO CLAIM PRIZES.
Sponsor will attempt to notify potential Prize winner of his/her winning status via the telephone number(s), and/or e-mail address provided in connection with the Prize winner’s registration within approximately three (3) to five (5) days of the applicable drawing date. Before any Prize is awarded, Prize winner must complete, sign, and return an Affidavit of Eligibility (“Affidavit”) and, where lawful, a Liability/Publicity Release (“Release”) (collectively, “Affidavit and Release”), releasing the Promotion Entities from any liability in connection with this Promotion or the receipt, possession, use or misuse of any Prize or the merchandise for which it is redeemed, within seven (7) days after notification, or, if a resident of Canada, a Declaration of Compliance and Publicity Release, within seven (7) days. If selected entrant is a minor (“Minor”) in his/her state/province/territory of residence, the parent or legal guardian of the Minor will be required to ratify the Affidavit and Release in order for the Prize to be awarded to the Minor. If the Affidavit and Release are not signed and returned prior to the time deadline indicated in the documents, or if a Prize winner does not meet eligibility criteria set forth in these Official Rules, or is otherwise unwilling or unable to comply with these Official Rules, or cannot be contacted within seven (7) days of the applicable drawing date, an alternate winner will be selected by Sponsor by random drawing from among all remaining eligible Promotion Teams, Promotion Team Members and mail-in participants, as applicable. Upon receipt and verification of the Affidavit and Release (or Declaration of Compliance and Publicity Release in the case of residents of Canada) and compliance with the Official Rules, the winner will be contacted with further details as to how Prize winner may claim the Prize. Before being declared a winner, residents of Canada must also correctly answer, without assistance of any kind, whether mechanical or otherwise, a time-limited mathematical skill-testing question to be administered by Administrator at a mutually agreeable time by telephone or by email. In the event that the potential winner cannot correctly answer the skill-testing question within the time limit specified by Administrator, such potential winner will be disqualified and an alternate winner may be selected, who will be subject to disqualification in the same manner.
6. ODDS OF WINNING.
The odds of being selected as eligible to win a Prize depend on the total number of eligible participants and Promotion Teams that participate in the Promotion
7. GENERAL TERMS AND LIMITATIONS OF LIABILITY AND RELEASES:
All submissions related to this Promotion, including but not limited to, mail-in cards, become the exclusive property of Sponsor and none will be acknowledged or returned. Proof of sending or submission will not be deemed to be proof of receipt by Sponsor and/or Administrator. All such submissions are subject to verification. By entering or otherwise participating in the Promotion and/or accepting any Prize, each participant hereby fully and unconditionally agrees to be bound by these Official Rules and the decisions of Sponsor and Administrator, or their respective designated agent, which are final and legally binding in all respects, and agrees to waive any right to claim any ambiguity in these Official Rules. Sponsor reserves the right to modify or revise these Official Rules at any time and for any reason. The participant also agrees to assume all risk of loss, damage, destruction, delay or misdirection of materials/mail/email submitted to or from Sponsor or Administrator, and further agrees that all prizes are awarded upon the condition that the Promotion Entities or any of their respective parent companies, subsidiaries, officers, directors, partners, principals, partnerships, employees or agents shall have no liability whatsoever and shall be held harmless for any injuries, losses, or damages of any kind to persons or property, including death, sustained, in whole or in part, directly or indirectly, in connection with or resulting from acceptance, possession or use/misuse of any Prize, or participation in this Promotion or participation in any Promotion-related activities and further acknowledge that said parties have neither made, nor are in any manner responsible or liable for, any warranty, representation or guarantee, expressed or implied, in fact or in law, relative to any prize awarded in connection with the Promotion.
Sponsor reserves the right, in its sole discretion, without prior notice or obligation and at any time, to cancel, terminate or suspend this Promotion, or any portion thereof, should virus, bugs, non-authorized human intervention or other causes beyond the control of Sponsor corrupt or impair the administration, integrity, security, fairness or proper conduct of the Promotion. In such event, Sponsor, at its discretion, may select winners from the eligible, non-suspect Promotion Teams fulfilling the applicable eligibility requirements prior to the event requiring such termination, cancellation or suspension. Sponsor reserves the right to correct any typographical, printing, computer programming or operator errors, including in the Official Rules. Sponsor reserves the right to verify the location of all Promotion Team Members’ Check-in Credits and checking in to a DQ Location without being immediately adjacent to or in the DQ Location perimeter (as determined solely by Location Based Network and/or Sponsor) is prohibited and will result in disqualification. The Promotion Entities and their respective parent companies, subsidiaries, officers, directors, partners, principals, partnerships, employees or agents are not responsible for hardware, software or telephone failures of any kind, traffic congestion on the internet or at any website or any combination thereof, lost network connections, incomplete, garbled or delayed computer transmissions, whether caused by Sponsor, users or by any of the equipment or programming associated with or utilized in the Promotion or by technical or human error which may occur and/or which may damage a user’s system or limit any participant’s ability to participate and/or redeem Prizes in the Promotion. Sponsor reserves the right at its sole discretion, to disqualify any individual who tampers with the Promotion, violates these Official Rules or otherwise engages in fraudulent or offensive conduct with respect to this Promotion. Caution: Any attempt to deliberately damage any website or undermine the legitimate operation or administration of the Promotion is a violation of criminal and civil laws and should such an attempt be made, Sponsor reserves the right to seek damages from any such participant to the fullest extent of the law.
By accepting a Prize, the winner agrees that Sponsor may use such winner’s name, city and/or state/province/territory of residence, statements, likeness, voice, photograph and/or biographical information, without limitation, for promotional purposes relating to the Promotion, in any media or format, whether now known or hereafter developed, including but not limited to the Internet, worldwide, in perpetuity, without further consideration or payment, where permitted by law. Prizes are awarded “as is,” “where is,” with no warranty or guarantee express or IMPLIED. Check-in Credits and Prizes are nonassignable and nontransferable. Check-in Credits have no cash or trade-in value. Sponsor reserves the right to substitute cash or prizes of equal or greater monetary value. Should a winner make any false statement(s) in any document referenced above, the winner will be required to promptly return to Sponsor his/her Prize, or the cash value thereof. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. Should any provision of these Official Rules be deemed unenforceable or invalid, the other provisions of these Official Rules shall remain in full force and effect. In the event that this Promotion is challenged by any legal or regulatory authority (including but not limited to any federal or state governmental authority), Sponsor reserves the right to discontinue or modify the Promotion, as applicable, or to disqualify any participant residing in any affected geographic areas, as applicable. In such event, Sponsor shall have no liability to any participants who are disqualified due to such an action.
9. DISPUTE RESOLUTION:
Except where prohibited, participants agree that: all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of any participant(s), Sponsor, Administrator, and their respective agents shall be governed by and construed exclusively in accordance with the laws of the State of Minnesota without giving effect to any principles of conflicts of law of any jurisdiction. Participants agree that any action at law or in equity arising out of or relating to this Promotion, or awarding of the Prizes, shall be filed only in the state or federal courts located in the State of Minnesota and the participants hereby consent and submit to the personal jurisdiction of such courts for the purposes of litigating any such action. Except where prohibited, by participating in this Promotion, the participants agree that: (a) any and all disputes, claims, and causes of action arising out of or connected with this Promotion, or awarding of the prizes, shall be resolved individually, without resort to any form of class action; and (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with participating in this Promotion but in no event attorneys’ fees; and (c) under no circumstances will any participant be permitted to obtain awards for and hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. Some jurisdictions do not allow the limitations or exclusion of liability for incidental or consequential damages, so the above may not apply to you.
10. PRIVACY:
Sponsor and its authorized agents will collect, use, and disclose the personal information you provide when you enter the Promotion for the purposes of administering the Promotion and Prize fulfillment. By entering this Promotion you consent to the collection, use, disclosure and management of your personal information for the purposes of administering this Promotion. All personal information that participants submit will be subject to Sponsor’s privacy policy. In the event of any discrepancy between Sponsor’s privacy policy and these Official Rules, the privacy policy will govern and control. Information collected by Sponsor in connection with this promotion will be maintained on servers located in the United States.
11. WINNER NAMES AND OFFICIAL RULES:
For the names of the Prizewinners and/or a copy of these Official Rules, eligible entrants residing in the U.S. may send a self-addressed stamped envelope to: 2012 OREO BLIZZARD 100, P.O. Box 94079, Atlanta, GA 30377, USA. All requests for a copy of the Official Rules and the names of winners must be made by December 31, 2012. Please note on the front left-hand corner of your outer envelope whether you are requesting “Official Rules” or the names of “Prize Winners.”
