The following Giveaway is intended for participants in the United States only and shall be construed and evaluated according to the laws of the United States. Do not proceed in this Giveaway if you are not a legal resident of the United States.
Further eligibility restrictions are contained in the official rules below.
ELIGIBILITY: The Lindt EXCELLENCE Pre-Launch Giveaway (the “Giveaway”) is open to all legal U.S. residents who are at least eighteen (18) years of age as of April 16, 2012. Void in Puerto Rico, all U.S. territories and possessions and where prohibited by law. Employees of Lindt & Sprungli (“Sponsor”), affiliates, subsidiaries, advertising and Giveaway agencies (collectively, the “Giveaway Parties”), persons living in the same households, and the families (spouse, parents, children and siblings) or household members of each are not eligible to participate. The Giveaway is subject to all applicable federal, state and local laws and regulations.
ENTRY: The Giveaway will begin on April 16, 2012 at 12:00:00 AM Eastern Standard Time and end on April 20, 2011 at 11:59:59 Eastern Standard Time (each such calendar day hereinafter referred to as an “Entry Period”). To participate in the Giveaway, entrants must complete and submit an online entry form. Entry form can be found by visiting http://www.facebook.com/lindtchocolate and clicking on the “Lindt Lovers” tab. Entrants must have a registered Facebook.com account to enter and must be fans of the Lindt Chocolate USA page to be eligible. ALL ENTRIES MUST BE RECEIVED BY 11:59:59 PM (EST) OF THE ENTRY PERIOD IN WHICH THE GIVEAWAY MESSAGE WAS ORIGINALLY POSTED. There is no charge to create an account on Facebook or to become a fan of the Lindt Chocolate USA Facebook page. Facebook not a sponsor of this Giveaway.
Limit one (1) entry per person per Entry Period. Any attempt to exceed the maximum number of entries, whether through use of multiple e-mail accounts, Facebook accounts or any automated system may result in disqualification.
No responsibility is assumed by Sponsor for lost, late, misdirected, illegible, incomplete, stolen, postage due mail, or mutilated entries or for any computer, online, telephone or technical malfunctions that may occur. Sponsor may reject any entry it believes is the result of fraud or was submitted in violation of the official rules.
PRIZES/ODDS: 1,000 Prizes: There will be one thousand (1,000) winners of the Giveaway (assuming sufficient number of eligible entries). Each winner will receive one (1) Lindt EXCELLENCE 3.5oz bar (flavor based on potential winner selection at time of entry) (“ARV”): $3.85 each. Winner’s chosen recipient must a legal resident of, and located in, the 50 United States or the District of Columbia.
No substitution, transfer, or cash equivalent for prizes, except that the Sponsor may, at its sole discretion, substitute prizes of comparable value or cash. Sponsor responsible for prize delivery; not responsible for prize quality or otherwise. Unclaimed prizes will not be awarded.
This is a game of chance. Odds of winning are based on eligible number of entries received during Giveaway period.
DRAWING: A random drawing will take place after the end of each Entry Period and the potential winners will be selected at random from all eligible entries received. The potential winners will be notified by Sponsor by email or telephone within approximately three (3) days of the drawing. If Sponsor is unable to contact the potential winner after reasonable effort, or if the potential winners fail to respond within five (5) days of first attempted notification, prize may be forfeited and awarded to an alternate winner.
CONDITIONS: By participating, entrants agree to abide by these Official Rules. Payments of all federal, state and local taxes are solely the responsibility of the winners. By participating in the Giveaway, the winner or winners agree to have their name, voice, or likeness used in any advertising or broadcasting material relating to this Giveaway without additional financial or other compensation, and, where legal, to sign a publicity release confirming such consent prior to acceptance of the prize. Released Parties are not responsible for: electronic transmissions or entries that are lost, late, stolen, incomplete, illegible, damaged, garbled, destroyed, misdirected or not received by the Sponsor or its agents for any reason, including but not limited to technical malfunctions, human error that may occur in the transmission or processing of entries, software or hardware failure, telecommunication errors, or any technical malfunction; whether caused by the sender or by any of the equipment or programming associated with or used in this contest, or by any human error which may occur in the execution of this contest.
If for any reason this Giveaway cannot be executed as planned, including but not limited to infection by computer virus, tampering, unauthorized intervention, fraud, technical failures of any kind, or any other causes beyond the control of the Released Parties that corrupt or affect the security, administration, fairness, integrity or proper conduct of this Giveaway, the Sponsor reserves the right to terminate or modify the Giveaway. If Giveaway is terminated before the original end date, Sponsor will select the winners by random drawing from among all eligible online entries received as of the termination time and date. Sponsor reserves the right, at its sole discretion, to disqualify and prosecute any individual who tampers with or attempts to tamper with the entry process or the operation of the participating parties’ websites or who enters using any automatic or programmed entry duplication method that is prohibited under these rules. CAUTION: ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE OR OTHERWISE CORRUPT OR UNDERMINE ANY OPERATION OF THE GIVEAWAY MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO DISQUALIFY, PROSECUTE AND SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
WINNERS LIST: The names of the winners may be obtained by sending a self-addressed, stamped envelope postmarked by May 31, 2012 to: Lindt & Sprungli (USA) Inc., 1 Fine Chocolate Place, Stratham, NH 03885, Attention: Lindt EXCELLENCE Pre-Launch Giveaway.
