1. ELIGIBILITY: Open to all legal U.S. residents of the 50 United States (including D.C.), who are 18 years of age or older at the time of entry. Employees (and household family members of such employees) of Sponsor and its parents, affiliates, subsidiaries and advertising, promotion and fulfillment agencies, and their affiliates are not eligible. No group submissions or collaborations are permitted. Neither Sponsor nor any of its affiliates are liable for any disputes between collaborators related to a submission. Game subject to all federal, state and local laws and regulations. Void where prohibited or otherwise restricted by law.
2. PROMOTION PERIOD: The DOLE® Big Apple Getaway Collect & Win Game and Instant Win Game (collectively referred to as the “Game”) begins at 12:00:01 p.m. ET on 5/16/12 and ends at 11:59:59 a.m. ET on 8/15/12 (the “Promotion Period”).
3. HOW TO GET A GAME CODE: An Official Game Code (each a “Code”) is required to play this Game. Codes are available inside specially marked packs of DOLE® Salad Blends, Kits and Extra Veggie™. For a free Code (while supplies last), send a self-addressed stamped envelope (VT residents may omit return postage) to: DOLE Big Apple Game, P.O. Box 3003, Rogers, MN 55374-3003. Code requests must be postmarked between 5/7/12 and 8/4/12 and must be received by 8/9/12 to coincide with the salad bag in-market dates. Limit one (1) Code request per outer postmarked envelope. There will be one (1) Code printed on each Game Piece. No mass or mechanically reproduced requests will be accepted. Codes are void if obtained through unauthorized channels. Codes have no cash value and may not be transferred, duplicated, auctioned, shared or sold. Sponsor reserves the right to distribute Codes through additional means during the Promotion Period at its sole discretion. Sponsor’s sole liability for any defective or erroneous Code is limited to replacement with one Code, while supplies last. Codes must be entered into the Game site during the Promotion Period.
4. HOW TO PLAY: Visit the Game page on facebook.com/DoleSaladGuide (“Web site”) and “Like” the DOLE Salad page if you haven’t already done so. Complete the registration form by entering your full name, street address (no P.O. boxes), city, state, zip code, daytime telephone number with area code, date of birth and e-mail address, and enter the Code found on your Game Piece. Entering a Code will trigger both the Collect & Win Game and the Instant Win Game:
   • COLLECT & WIN GAME: Upon entering the Code, you will be randomly awarded with one (1) of the following five (5) salad ingredients: The Big Apple, The Celery, The Crouton, The Red Onion or The Walnut (each a “Salad Ingredient”). Each Salad Ingredient entered into play will be stored in the participant’s registration file and will appear on participant’s game board each time you log into the Game. Only one (1) Big Apple Salad Ingredient will be randomly awarded throughout the Promotion Period. Once you have collected each of the five (5) Salad Ingredients, you must submit your completed game board to claim the Grand Prize and begin the verification process. The Grand Prize will be awarded at the end of the Game, following winner verification.
   • INSTANT WIN GAME: Upon entering the Code, you will also receive a message on-screen notifying you as to whether or not you are a potential winner of an Instant Win Game prize. You are not a winner of any prize unless and until your eligibility is confirmed and your Game play is verified to be in accordance with these Official Rules. All Instant Win Game prizes will be awarded at the end of the Game, following winner verification. Instant Win Game prizes will be mailed to the mailing address entered on the registration form. Please allow approximately 6−8 weeks for delivery of prizes.

    

5. WINNER DETERMINATION/ODDS: Codes are not used to determine winners. The time that your Code submission is processed and recorded by the Game technology will solely determine whether or not you are a potential instant prize winner and what Salad Ingredient you will be awarded. Winning dates and times are randomly seeded across the Promotion Period, and Instant Win Game prizes and the winning Salad Ingredient are randomly awarded to the first eligible participant whose Game play occurs on or after each winning time frame. If multiple entries are received at exactly the same time, the Game technology will assign each a different, or next available, unused time. The Web site server time will be the official timekeeping device for this Game. If you are a potential instant winner of an Instant Win Game prize, you will see a Congratulations notification and you will win the indicated prize, subject to verification of eligibility and compliance with these Official Rules. If you have collected each of the five (5) Salad Ingredients, you must submit your completed game board, which will be verified at the end of the Promotion Period. You are not a winner until your eligibility and Game play have been verified. ODDS: Odds of winning depend upon the number of participants playing the Game and the date and time of each play.
6. ENTRY CONDITIONS: Each participant (“you”) may only use one (1) e-mail address to participate in this Game, and such e-mail address may only be used by one (1) person, regardless of whether the e-mail address is shared by two (2) or more people. Any participant who uses more than one (1) e-mail address to participate in this Game may be disqualified and any prizes won may be forfeited, subject to Sponsor’s sole discretion. Automated entries are prohibited and any use of such automated devices will result in disqualification. In the event of a dispute as to the identity of a participant, the authorized account holder of the e-mail address used to enter will be deemed the participant. The “Authorized Account Holder” is the natural person assigned an e-mail address by an Internet access provider, online service provider or other organization responsible for assigning e-mail addresses for the domain associated with the submitted address. Each potential winner may be required to show proof of being the Authorized Account Holder, as well as any other proof of eligibility that Sponsor may request. All entries become the exclusive property of Sponsor and will not be acknowledged or returned. By playing this Game, participants accept and agree to be bound by these Official Rules and the decisions of the judges, which shall be final, binding and conclusive on all matters.
7. COLLECT & WIN: GRAND PRIZE (1): : One (1) Grand Prize winner will receive a 5-day/4-night travel package to New York City for winner and up to four (4) guests. Travel package includes: (i) round-trip coach airfare for winner and each guest from the major airport nearest the winner’s or guest’s residence to New York City; (ii) four (4) nights’ hotel accommodations (double-occupancy; room and hotel to be determined solely by Sponsor); (iii) ground transfers to/from home, airport and hotel; (iv) $6,000 spending money payable to winner in the form of a check; (v) $1,500 Saks Fifth Avenue gift card; (vi) a private cooking class at Eataly’s La Scuola for winner and each guest; (vii) Broadway tickets for winner and each guest (up to $350 per person) to a show of winner’s choice (show, dates/times and seats subject to availability); (viii) a $300 Red Door Spas gift card for winner and each guest; (ix) a New York City Pass for winner and each guest, which provides entrance into the Empire State Building, American Museum of Natural History, The Metropolitan Museum of Art, The Museum of Modern Art (MoMA), Guggenheim Museum, Statue of Liberty & Ellis Island or Circle-Line Sightseeing Cruise; (x) a Sony Bloggie Touch Camera for winner and each guest. APPROXIMATE RETAIL VALUE (“ARV”) OF THE GRAND PRIZE BASED ON FIVE (5) TRAVELERS IS $40,000.00. Acceptance of the Grand Prize is subject to the travel conditions in Sections 8 and 10, below.
8. GRAND PRIZE TRAVEL CONDITIONS: Grand Prize winner and guest(s) must be available to travel between March 1, 2013 and May 31, 2013. If Grand Prize winner is unable to complete the trip within these dates, and/or is unable to accept the prize as stated, the Grand Prize winner will forfeit the prize in its entirety. If Grand Prize winner or guest(s) resides within 200 miles of the trip location, ground transportation will be provided in lieu of airfare and no cash difference will be awarded. Sponsor is not responsible for substituting tickets in the event of show cancellations or postponements and no alternate prize will be awarded subject to Sponsor’s discretion. Winner and his/her guest(s) are solely responsible for their own conduct while on the trip and agree to comply with applicable rules, laws and regulations. Any costs/expenses not expressly stated herein, including, but not limited to, food, beverages, gratuities, and additional transportation are the sole responsibility of the Grand Prize winner and each guest. Grand Prize winner and guest(s) must travel on the same itinerary. Trip concierge will work with Grand Prize winner to coordinate travel and hotel. Once the travel has been booked, the winner may not change it. Sponsor is not responsible for weather conditions, cancellations, delays, postponements, or any winner’s or guest’s inability to participate in any portion of the Grand Prize. Guests of Grand Prize winner must be at least 18 years of age or older. If Grand Prize winner or any guest is considered a minor in his/her state of residence, he/she must be accompanied at all times during trip by minor’s parent or legal guardian. Sponsor reserves the right to substitute the Grand Prize or any part thereof with a prize of equivalent or greater value, in its discretion, if circumstances so require. This experience is NONTRANSFERABLE and may not be resold.
9. INSTANT WIN GAME PRIZES: FIRST PRIZES (150): One hundred fifty First Prize winners will each receive a $100 Restaurant.com gift certificate (ARV $100). SECOND PRIZES (150): One hundred and fifty Second Prize winners will each receive a $100 SpaFinder gift certificate (ARV $100). THIRD PRIZES (100): One hundred Third Prize winners will each receive a salad bowl set with utensils (ARV $50). FOURTH PRIZES (250): Two hundred fifty Fourth Prize winners will each receive a $15 Visa gift card (ARV $15). FIFTH PRIZES (10,000): Ten thousand Fifth Prize winners will each receive a free package of DOLE® Salad. Free salad will be awarded in the form of one coupon, good for one (1) free bag of salad, up to a maximum retail price of $4.99 (ARV $4.99). Winning an Instant Win prize does not preclude participant from being eligible to win the Grand Prize in the Collect & Win Game. TOTAL ARV OF ALL PRIZES: $88,650.
10. PRIZE CONDITIONS FOR ALL PRIZES: No transfer or assignment of prizes permitted. Prizes may not be redeemed for cash or otherwise substituted except as provided herein. Prizes will be awarded “as is” with no warranty or guarantee, either express or implied. Gift cards and gift certificates are subject to the terms and conditions of the issuer and state and federal law. Any prizes depicted on promotional packaging, point-of-sale, or otherwise in connection with this Game are for illustrative purposes only and may not reflect the actual prizes awarded or received. Sponsor reserves the right to substitute a prize with cash or another prize of equal or greater value. Any difference between a stated Approximate Retail Value and actual value of any prize will not be awarded. All income taxes on prizes are the sole responsibility of each winner. Winners will be taxed on the actual retail price of the prize (e.g. Grand Prize winner who takes fewer than the allowable number of guests will be taxed accordingly). A 1099 form will be issued to any winner (or parent or legal guardian if winner is an eligible minor) who receives a prize or cumulative prizes totaling a value of $600 or more and will be required to complete an Affidavit of Eligibility Publicity/Liability Release as a condition of receiving the prize, except where prohibited by law. In the event that a potential winner is considered a minor in his/her state of residence (18 years of age or under 19 in AL or NE), the prize will be awarded to the parent/legal guardian on behalf of such minor, who must agree to execute all required documents. Sponsor is not responsible for inability of any winner to accept a prize in accordance with these Official Rules. Any documents requested by Sponsor must be returned within the time specified or the prizewinner will be disqualified. Return of any prize or prize notification as undeliverable will result in disqualification. By entering this Game and accepting a prize, each winner consents to the use of winner’s name, photographs, biographical information, voice recordings and likenesses for advertising or publicity purposes by Sponsor in commerce and in any media worldwide without limitation and without additional compensation, notice or permission, where permitted by law
11. SECOND CHANCE DRAWING FOR THE GRAND PRIZE: If the Collect & Win Game Grand Prize is unawarded at the end of the Promotion Period or if the potential winner is disqualified or otherwise forfeits the prize, Sponsor’s game administrator will conduct a random drawing from among all eligible participants who registered to play the Game online. Participants who won an Instant Win Game prize during the Promotion Period will be eligible for the Second Chance Drawing. The Second Chance Drawing will be held on or about 9/4/12. Odds of winning depend on the total number of eligible registrants during the Promotion Period. Within 1−2 weeks following the Second Chance Drawing, the potential winner will be notified by mail at the address provided at the time of registration. If potential winner does not respond within the time specified in the notification or potential winner cannot accept prize as stated, prize will be forfeited in its entirety and an alternate winner may be chosen from the Second Chance Drawing pool, if feasible. Please allow 1–2 weeks after verification of eligibility for the arrangement of the prize delivery.
12. RELEASE OF LIABILITY: Except where prohibited, by participating in the Game, each participant agrees to release and hold harmless the Sponsor, Facebook and their respective parents, subsidiaries and affiliated companies and officers, directors, employees, agents, licensees, assigns, and advertisers, partners and agencies from and against any claim or cause of action arising out of participation in the Game or receipt or use of any prize, including, but not limited to: (a) unauthorized human intervention in the Game; (b) technical errors, programming errors, transmission defaults or interruptions related to computers, equipment, software, servers, or telephone or network lines; (c) computer server failure and/or delayed, garbled or corrupted data transmitted by participants or the Web site; (d) printing, typographical or human errors; (e) errors in the administration of the Game or the seeding prizes and Salad Ingredients; (f) late, lost, misdirected, postage-due or incomplete entries, game piece requests or undeliverable mail, e-mail or shipments; or (g) injury or damage to persons or property that may be caused, directly or indirectly, in whole or in part, from participant’s participation in the Game, or receipt or use of a prize. Participants agree that all causes of action arising out of or connected with this Game, or any prize awarded, shall be resolved individually, without resort to any form of class action; and any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, excluding attorneys’ fees and court costs. Participants agree that all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, participants’ rights and obligations, or the rights and obligations of the Sponsor in connection with the Game, shall be governed by, and construed in accordance with, the laws of the state of California, without giving effect to any choice of law or conflict of law rules. By participating, participants consent to the jurisdiction and venue of the federal, state and local courts located in California, County of Los Angeles.
13. GENERAL CONDITIONS: If for any reason this Game is not capable of running as planned; or if this Game becomes corrupted or does not allow the proper administration of the Game in accordance with these full Official Rules for any reason; or if tampering, unauthorized intervention, actions by participant(s), fraud, technical failures or any other causes, in the sole opinion of Sponsor, corrupts or affects the administration, security, fairness, integrity or proper conduct of this Game, Sponsor reserves the right, in its sole discretion, to disqualify any individual implicated in such action and/or to cancel, terminate, modify or suspend the Game, or any portion thereof, immediately, without obligation. In the event Sponsor terminates the Game prematurely, Sponsor has the right, but not the obligation, to conduct a drawing for the unawarded Collect & Win Grand Prize and Instant Win prizes from all eligible registrants received prior to the effective date of termination. Sponsor is not responsible for printing or typographical errors in any Game-related materials and reserves the right to correct clerical or typographical errors as needed. Any Game play will be automatically void if it is determined to be mass or mechanically reproduced, altered or tampered with in any way. Under no circumstances will more prizes than those set forth in these Official Rules be awarded. If a technical or seeding error, or the like, results in more potential winners than available prizes for a particular prize level, Sponsor reserves the right to award only the stated number of prizes by a random drawing among all legitimate, eligible prize claims. Any use of micro, automatic, programmed, robotic, or like entry methods will void all such entries by such methods, and participants using such methods will be disqualified. Further, any attempt by a participant or any other individual to deliberately damage, interfere with, or undermine the legitimate operation of this Game is a violation of criminal and/or civil laws, and should such an attempt be made, Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these full Official Rules shall not constitute a waiver of that provision.
